With this Privacy Policy, we would like to inform you about how we process personal data and explain your rights to you. We are aware of the importance of the processing of personal data for you as a data subject and therefore comply with all applicable statutory requirements. In doing so, the protection of your privacy is of the utmost importance to us. The processing of your personal data by us is carried out in compliance with the General Data Protection Regulation (GDPR) as well as the federal and state data protection provisions.

Definitions
This Privacy Policy uses the terminology of the General Data Protection Regulation (GDPR).

“Profiling” means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

“Pseudonymisation” means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

“Filing system” means any structured set of personal data which are accessible according to specific criteria, whether centralised, decentralised or dispersed on a functional or geographical basis.

“Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union law or Member State law, the controller or the specific criteria for its nomination may be provided for by Union law or Member State law.

“Processor” means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

“Recipient” means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union law or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.

“Third party” means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

“Consent” of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

Processing Operations
We collect and process the following personal data about you:
• contact and address information, provided that you have transmitted your contact information to us or registered on our website,
• online identifiers (e.g. your IP address, browser type and browser version, the operating system used, the referrer URL, the file name, access status, the amount of data transferred, the date and time of the server request),
• social media identifiers.

Purposes of Processing
We process your data for the following purposes:
• for the contact requested by you,
• for the provision of our services,
• for contract performance, in particular for the processing of orders and invoicing,
• for advertising purposes,
• for quality assurance, and
• for statistical purposes.

Legal Basis for Data Processing
The processing of your data is based on the following legal grounds:

• Consent (Art. 6 (1) sentence 1 lit. a GDPR) – The data subject has given consent to the processing of his or her personal data for one or more specific purposes.

• Performance of a contract and pre-contractual enquiries (Art. 6 (1) sentence 1 lit. b GDPR) – Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.

• Legal obligation (Art. 6 (1) sentence 1 lit. c GDPR) – Processing is necessary for compliance with a legal obligation to which the controller is subject.

• Legitimate interests (Art. 6 (1) sentence 1 lit. f GDPR) – Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

Legitimate Interests
Where we base the processing of your personal data on legitimate interests pursuant to Art. 6 (1) lit. f GDPR, such interests include:

• the improvement of our services,

• protection against misuse, and

• the maintenance of our statistics.

Data Sources
We receive the data from you (including via the devices you use). If we do not collect the personal data directly from you, we will additionally inform you of the source from which the personal data originate and, where applicable, whether they originate from publicly accessible sources.

Recipients or Categories of Recipients of the Personal Data
In processing your data, we work with the following service providers who have access to your data:

• providers of web analytics tools,

• web hosting providers,

• payment service providers,

• transport service providers,

• Schufa.

Data are transferred to third countries outside the European Economic Area. This is carried out on the basis of contractually agreed provisions required by law, which are intended to ensure an adequate level of protection for your data and which you may inspect upon request.

Data Processing in Third Countries
Where we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or where such processing takes place in the context of using third-party services or the disclosure or transfer of data to other persons, bodies or companies, this shall only take place – subject to explicit consent or contractually or legally required transfer – in third countries with a recognised level of data protection, on the basis of contractual obligations through so-called Standard Contractual Clauses of the European Commission or in the presence of certifications or binding corporate rules (Art. 44 to 49 GDPR). Storage Period
We store your personal data only for as long as is necessary to achieve the purpose of processing or as long as storage is subject to a statutory retention period.

In addition, we store your data:

• if you have consented to the processing, at most until you withdraw your consent,

• if we require the data for the performance of a contract, at most for the duration of the contractual relationship,

• if we process the data to comply with a legal obligation, at most for the duration of the legal obligation,

• if we use the data on the basis of a legitimate interest, at most until your interest in erasure or anonymisation outweighs our interest.

Data Security
We have implemented extensive technical and organisational measures to protect your data against potential risks such as unauthorised access or access by unauthorised persons, unauthorised disclosure, alteration or dissemination, as well as loss, destruction or misuse.

In order to protect your personal data against unauthorised access by third parties during transmission, we may secure data transmissions using SSL encryption. This is a standardised encryption procedure for online services, in particular for the web.

Log Files
Each time our website is accessed, usage data are transmitted by the respective internet browser and stored in log files, known as server log files. The data records stored include the following data: domain from which the user accesses the website, date and time of access, IP address of the accessing computer, website(s) visited by the user, amount of data transferred, browser type and version, operating system used, name of the internet service provider, and notification as to whether the access was successful.

These log file records are used to ensure the proper operation of our services (e.g. troubleshooting, load management of the server) and for the prevention of misuse and threats (e.g. hacker attacks). This constitutes our legitimate interest in data processing pursuant to Art. 6(1) sentence 1 lit. f GDPR. These data are not passed on to third parties. The access data stored in the log files are retained for a maximum of 7 days.

Your Rights
You have – in part subject to certain conditions – the right:

• to request free information about the processing of your data and to receive a copy of your personal data (Art. 15 GDPR). This includes, inter alia, information about the purposes of processing, the categories of personal data processed, the recipients of the data (if disclosed), the duration of storage or the criteria used to determine that duration;

• to have your data rectified (Art. 16 GDPR). If your personal data are incomplete, you have the right, taking into account the purposes of the processing, to have the data completed;

• to have your data erased (Art. 17 GDPR). Grounds for erasure may include, inter alia: withdrawal of consent on which the processing is based, objection by the data subject to the processing, unlawful processing of personal data;

• to restrict processing (Art. 18 GDPR);

• to object to the processing of your data (Art. 21 GDPR);

• to data portability, i.e. to receive your data in a structured, commonly used and machine-readable format and to transmit those data to another controller or have them transmitted (Art. 20 GDPR).

You also have the right:

• to withdraw your consent to the processing of your data at any time with effect for the future (Art. 7 (3) GDPR), and

Unless explicitly stated otherwise at the time of collection, the provision of data is neither required nor mandatory. Such an obligation may arise from statutory provisions or contractual arrangements.
